SUMMARY: The ecclesiastical provinces between tradition and the present pastoral necessities: argumentatio in iure ed in facto, referring especially to the Romanian Orthodox Church
The synodal canonic legislation offers us valuable information as concerns the administrative organization of the ancient Church. This administrative organization represents even today a landmark in considering the territorial boundaries and the jurisdictional attributions of various Orthodox local Churches. However, a strict interpretation of ancient norms, without taking into consideration the new historical and pastoral realities can obviously cause conflicts between different local Churches, but also inside one Church, the main accusation being that of breaking the canonic law and tradition. The principle of the unity in diversity, allows, without doubt, a permanent dynamism in the field of the territorial administrative organisation of the Church inside and outside the territorial traditional national boundaries as well. Such a principle is highlighted in the Romanian Orthodox Church as well, a Church which continues to respond to the pastoral necessities of its believers, an example in this respect being the foundation of new eparchies inside and outside Romania, thus changing the traditional Church administrative configuration. As concerns the Diaspora, beyond all the debates referring to the jurisdiction right, the Romanian Church constantly observes the principle of the diversity of Orthodoxy in an ethnic Church multiplicity, organised neither in an isolated way, nor in a centralized territory, but rather in a canonical way. The principle which governs the administrative organisation of the Diaspora in ethnic ecclesial units is not the territorial one, but above all, the jurisdictional one.La legislazione canonica sinodale ci fornisce informazioni importantissimecirca l’organizzazione amministrativa della Chiesa antica. Quest’organizzazione amministrativa antica rappresenta anche oggi unpunto di riferimento nella valutazione dei limiti territoriali e delle competenzegiurisdizionali delle diverse Chiese ortodosse locali. Peròun’interpretazione strictu sensu della normativa antica, senza tenerconto delle nuove realtà storiche e pastorali, ovviamente potrebbe causaredei conflitti tra diverse Chiese locali, ma anche all’interno di unaChiesa locale stessa, con delle accuse di trasgressione della legislazionee della tradizione canonica.
